Kyle Shideler, director of counterterrorism research at the right-wing think tank Center for Security Policy, had been key to the prosecution\u2019s case that \u200b<span>\u201c<\/span>antifa\u201d\u2009\u2014\u2009the loose network of activists defined by their opposition to fascism\u2009\u2014\u2009is a\u00a0violent, criminal organization bent on overthrowing the U.S. government. Shideler, an imposing figure with a\u00a0cleanly shaven head and full beard, had attended nearly the entire trial, even sitting in the overflow room during jury\u00a0selection.<\/p>\n<p>At the stand, Shideler read aloud the government\u2019s definition of antifa, as well as an excerpt from President Donald Trump\u2019s executive order declaring antifa a\u00a0domestic terrorist organization\u2009\u2014\u2009issued in September, less than two weeks after the assassination of right-wing pundit and activist Charlie Kirk. Both documents describe antifa as a\u00a0shadowy, militant \u200b<span>\u201c<\/span>enterprise\u201d involved in \u200b<span>\u201c<\/span>coordinated efforts to obstruct\u201d enforcement of federal laws through \u200b<span>\u201c<\/span>organized riots,\u201d and in perpetrating \u200b<span>\u201c<\/span>violent assaults\u201d against ICE agents and law enforcement\u00a0officers.<br\/><\/p>\n<\/div>\n<div>\n<p>Three days later, on March <span>13<\/span>, the jury convicted all nine defendants on a\u00a0variety of charges, ranging from providing material support to terrorists to attempted murder. The ruling could have far-reaching consequences for activists, protesters and NGOs that have aligned themselves in any way with anti-fascist\u00a0organizing.\u00a0<\/p>\n<p>But FBI records obtained by <em>Type Investigations<\/em> and <em>In These Times<\/em> through a\u00a0Freedom of Information Act request contradict the government\u2019s claim that antifa poses an existential threat to national security. And several defense attorneys involved in the trial say the information should have been included in\u00a0discovery.\u00a0<\/p>\n<p>MarQuetta Clayton, an attorney representing Maricela Rueda\u2009\u2014\u2009one of the defendants convicted of providing material support to terrorists, organizing a\u00a0riot and conspiracy to conceal documents\u2009\u2014\u2009confirmed that the records were not turned\u00a0over.\u00a0<\/p>\n<p><span>\u201c<\/span>Coupled with some of the testimony we heard, I\u00a0feel like that would all be something for the jury to decide whether it was worth anything or not,\u201d Clayton said. \u200b<span>\u201c<\/span>They are the tryers of credibility and\u00a0fact.\u201d<br\/><\/p>\n<\/div>\n<div>\n<p>The case centered around a\u00a0noise demonstration on July <span>4<\/span>, <span>2025<\/span>, in which roughly a\u00a0dozen activists set off fireworks outside the Prairieland ICE detention center in Alvarado, Texas, about a\u00a0<span>45<\/span>-minute drive south of Dallas. Noise demonstrations are a\u00a0common protest tactic, sometimes involving fireworks, whistles or megaphones, and a\u00a0way of expressing solidarity with immigrant detainees or inmates who have little contact with the outside world. At least one protester spray painted a\u00a0guard shack and a\u00a0vehicle in the Prairieland parking lot with expletives and anti-ICE slogans and dismantled a\u00a0security camera. Some of the protesters also had firearms\u2009\u2014\u2009which in Texas, an open-carry state, is generally\u00a0legal.\u00a0<\/p>\n<p>When a\u00a0police officer arrived on scene and pulled his gun, allegedly pointing it at someone running away from him, one of the protesters fired an AR-<span>15<\/span> style rifle in the officer\u2019s direction. The officer was hit just below the neck and suffered minor injuries. That night, and in the weeks that followed, the FBI and state law enforcement raided activists\u2019 homes and arrested <span>19<\/span>\u00a0people.\u00a0<\/p>\n<p>The shooter, Benjamin Song, a\u00a0<span>32<\/span>-year-old former U.S. Marine Corps reservist\u2009\u2014\u2009who remained at large for <span>11<\/span>\u00a0days\u2009\u2014\u2009was charged with three counts of attempted murder. (The officer who was shot, Thomas Gross, testified that he believed he was being ambushed and that his life was in danger. On the last day of the trial, Song\u2019s defense argued that he wasn\u2019t aiming at the officer at all but had fired \u200b<span>\u201c<\/span>suppressive\u201d shots toward the ground and that the bullet, which showed signs of impact with a\u00a0hard surface, had ricocheted before grazing the officer.)<br\/><br\/>Other charges included organizing and carrying out a\u00a0riot, providing material support to terrorists and conspiracy to use and carry an explosive. Roughly half a\u00a0dozen activists not at the protest on the night of July <span>4<\/span>\u00a0were also apprehended and charged with a\u00a0variety of state and federal offenses, including one accused of conspiracy to conceal documents for moving a\u00a0box of anarchist zines to a\u00a0friend\u2019s apartment. (The FBI also raided that home, using a\u00a0battering ram to break through the front door and detonating a\u00a0flash bang device in the living room, and confiscated all of the occupants\u2019 phones and laptops, which have still not been\u00a0returned.)\u00a0<br\/><\/p>\n<p>In the months since, the Prairieland case became the cornerstone of the Trump administration\u2019s efforts to dismantle antifa and crack down on the Left more broadly. In October <span>2025<\/span>, when the first indictment in the case was unsealed, FBI Director Kash Patel said it was the \u200b<span>\u201c<\/span>first time\u201d the government had arrested \u200b<span>\u201c<\/span>Antifa-aligned anarchist violent extremists\u201d and charged them with terrorism\u2009\u2014\u2009despite the fact that antifa is not a\u00a0formal organization and has no membership list or leadership\u00a0hierarchy.\u00a0<\/p>\n<p>Making that charge stick is what prosecutors set out to achieve in court. Along with the administration\u2019s crackdown on dissent\u2009\u2014\u2009its use of ICE agents to threaten and detain student protesters, for example\u2009\u2014\u2009this case will likely be used to target the Left and launch investigations into anyone with connections, however tenuous, to\u00a0antifa.<\/p>\n<\/div>\n<div>\n<p>In a\u00a0statement released a\u00a0few hours after the verdict, the Department of Justice cited Shideler\u2019s testimony and referred to the North Texas \u200b<span>\u201c<\/span>Antifa Cell\u201d nearly a\u00a0dozen times. Attorney General Pam Bondi reiterated the administration\u2019s claim that \u200b<span>\u201c<\/span>Antifa is a\u00a0domestic terrorist organization\u201d and said the Prairieland case marked the beginning of a\u00a0broader effort to \u200b<span>\u201c<\/span>systematically dismantle\u201d the\u00a0group.<\/p>\n<p>Shideler, asked to comment on his testimony in the hallway outside of the courtroom, told <em>Type Investigations<\/em> and <em>In These Times<\/em>, \u200b<span>\u201c<\/span>I\u2019m not taking any\u00a0questions.\u201d<br\/><\/p>\n<p>But the government did not always consider antifa a\u00a0serious threat. Records from an FBI investigation out of the Dallas field office that ended in <span>2018<\/span> reveal that, under Trump\u2019s first term, the bureau had investigated \u200b<span>\u201c<\/span>Antifa DFW\u201d (and several allegedly related entities, including Dallas Workers Front, Dallas Antifa, Antifa Dallas, Dallas Antifascist and DFW Anti-Fascist League) and found that the group and its affiliates posed no threat to national security. This determination prompted the bureau to formally close the\u00a0investigation.\u00a0<\/p>\n<p><span>\u201c<\/span>No potential criminal violations or priority threats to national security warranting further investigation were identified,\u201d the two-page FBI file\u00a0states.<br\/><\/p>\n<\/div>\n<div>\n<div>\n<div>\n<div>\n              Document\n            <\/div>\n<\/div>\n<div>\n<div>\n<iframe loading=\"lazy\" height=\"480\" src=\"https:\/\/drive.google.com\/file\/d\/1WO7-RIS41as5ugjKFjU_8w0Ge3EABu3x\/preview\" width=\"640\"><\/iframe>\n<\/div>\n<div><p>FBI records obtained by <em>Type Investigations<\/em> and <em>In These Times<\/em> through a Freedom of Information Act request contradict the government\u2019s claim that antifa poses an existential threat to national security. <\/p><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<p>The records are at odds with the case prosecutors presented during the three-week trial and indicate that, as of <span>2018<\/span>, the top law enforcement agency in the country did not view antifa as a\u00a0criminal threat. (Around the same time, the FBI also opened a\u00a0case on Rose City Antifa in Portland, Oregon, suggesting that the agency\u2019s mandate to investigate activists involved in the anti-fascist coalition extended beyond Dallas\/\u200bFort Worth. It is unclear if the Rose City investigation was\u00a0closed.)<\/p>\n<p>According to five defense attorneys\u2009\u2014\u2009three of whom were involved in the federal case and two who are representing defendants facing state-level charges\u2009\u2014\u2009this information was not included in the discovery evidence that the government provided to the defense\u00a0teams.<br\/><\/p>\n<p><span>\u201c<\/span>The prosecution broke the law when it hid this evidence from the defense,\u201d said Texas attorney George Lobb, who is representing one defendant in the state\u2019s case. \u200b<span>\u201c<\/span>This internal FBI document shows the government lied about the defendants, because it presents a\u00a0position contrary to what the prosecution alleged at trial. In a\u00a0phone interview, Melinda Urbina Garcia, spokesperson for the FBI\u2019s Dallas field office, affirmed that the U.S. Attorney\u2019s office would have been aware that this investigation had taken place, though she added that there has been turnover in the office since\u00a0<span>2018<\/span>.<\/p>\n<p><span>\u201c<\/span>If the case was closed and no charges were brought, then obviously it is safe to say that there was a\u00a0declination to prosecute,\u201d Urbina Garcia\u00a0said.\u00a0<\/p>\n<p>The U.S. Attorney\u2019s Office in Texas declined to\u00a0comment.\u00a0<br\/><\/p>\n<\/div>\n<div>\n<\/div>\n<div>\n<p>The handling of the trial by Judge Mark T. Pittman\u2009\u2014\u2009a Trump appointee and member of the Federalist Society\u2014raised questions from the very beginning. On day one of jury selection, Pittman declared a\u00a0mistrial after learning that defense attorney MarQuetta Clayton was wearing a\u00a0T-shirt featuring images of civil rights leaders under her blazer, which he called prejudicial. Pittman was also reportedly unhappy with prospective jurors\u2019 responses to questions about ICE and law enforcement\u2019s handling of recent protests, and subsequently called a\u00a0new, smaller jury pool which he questioned himself. He also moved the trial to a\u00a0smaller courtroom, prompting speculation among media that he was trying to limit press\u00a0coverage.<\/p>\n<p>Even before the trial began, there were concerns that Pittman\u2014who has a\u00a0reputation for sanctioning and fining defense attorneys\u2014was trying to tip the scales. In January, Zachary Evetts, one of the defendants charged with material support for terrorism, submitted a\u00a0motion for additional discovery, including any information used by law enforcement and prosecutors to conclude that the \u200b<span>\u201c<\/span>North Texas Antifa Cell\u201d was a \u200b<span>\u201c<\/span>militant enterprise.\u201d Pittman denied the request and fined Evetts\u2019 lawyers $<span>500<\/span> each for filing what he called \u200b<span>\u201c<\/span>frivolous\u201d motions. (Pittman also granted a\u00a0motion filed by the government that precluded defense attorneys from making the case that the protesters may have acted in self defense, which took on greater significance when it was revealed during the trial that the officer pulled his gun\u00a0first.)\u00a0<br\/><\/p>\n<\/div>\n<div>\n<div>\n<div>\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" alt=\"\" class=\"wp-image-26\" height=\"768\" src=\"https:\/\/summitrelocationtimess.com\/wp-content\/uploads\/2026\/05\/ea554af2b5b22b6c050ac273123e4b7d-1024x768.jpeg\" width=\"1024\" srcset=\"https:\/\/summitrelocationtimess.com\/wp-content\/uploads\/2026\/05\/ea554af2b5b22b6c050ac273123e4b7d-1024x768.jpeg 1024w, https:\/\/summitrelocationtimess.com\/wp-content\/uploads\/2026\/05\/ea554af2b5b22b6c050ac273123e4b7d-300x225.jpeg 300w, https:\/\/summitrelocationtimess.com\/wp-content\/uploads\/2026\/05\/ea554af2b5b22b6c050ac273123e4b7d-768x576.jpeg 768w, https:\/\/summitrelocationtimess.com\/wp-content\/uploads\/2026\/05\/ea554af2b5b22b6c050ac273123e4b7d.jpeg 1500w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n<div>Banner criticizing Judge Mark Pittman, who moved the high-profile Prairieland trial to a smaller courtroom.  <span>Photo: Adam Federman<\/span>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<p>According to their motion, lawyers for Evetts asked prosecutors multiple times about their findings that antifa posed a\u00a0threat.\u00a0<\/p><p>Read more <a href=\"https:\/\/summitrelocationtimess.com\/?p=17\">ICE-Cold Cash: Members of Congress Took More than $1.7 Million from ICE Contractors<\/a><\/p>\n<p><span>\u201c<\/span>There are matters in the request that I\u00a0reasonably believe that you have not yet provided, but should,\u201d Patrick McLain, Evetts\u2019 lead defense attorney, wrote in an email to prosecutors in\u00a0October.<br\/><\/p>\n<p>Assistant U.S. Attorney Shawn Smith, one of the lead prosecutors, replied that they had fulfilled their discovery obligations. \u200b<span>\u201c<\/span>The government has not identified any extraneous evidence that is not part and parcel of the charged conspiracy,\u201d he\u00a0wrote.\u00a0<br\/><\/p>\n<p>But during the trial, McLain told <em>Type Investigations<\/em> and <em>In These Times<\/em>, key pieces of evidence related to the events that took place on the night of July <span>4<\/span>\u2009\u2014\u2009including the fact that the officer was the first to pull his weapon\u2009\u2014\u2009had not been disclosed to the defense. \u200b<span>\u201c<\/span>We did not have evidence that they should have had and should have shared with us,\u201d McLain\u00a0said.\u00a0<\/p>\n<p>McLain also noted that the FBI records would be \u200b<span>\u201c<\/span>grist for our appeal,\u201d especially if they choose to challenge the judge\u2019s denial of the discovery\u00a0motion.\u00a0<\/p>\n<p>Moira Meltzer-Cohen, an attorney whose work focuses on politically motivated abuse of the legal system, and who was not part of the Prairieland case, said that evidence deemed favorable to the defense must be included in discovery. This encompasses information that could affect rulings on certain motions as well as records in the possession of law enforcement that may, in some way, undermine the charged offense. Failure to share information that could impact the outcome of the case, she said, is a\u00a0violation of defendants\u2019 constitutional\u00a0rights.\u00a0<br\/><\/p>\n<\/div>\n<div>\n<p><span>\u201c<\/span>The prosecution has constitutional, common law and professional ethical obligations to disclose to defendants any \u200b<span>\u2018<\/span>favorable\u2019 evidence within the possession, custody, control or knowledge of any law enforcement personnel acting in the case,\u201d Meltzer-Cohen\u00a0said.\u00a0<\/p>\n<p>It\u2019s fair to say that a\u00a0prior FBI investigation finding that \u200b<span>\u201c<\/span>Dallas Antifa\u201d in fact posed no threat to national security would fit in that\u00a0category.<\/p>\n<p>Mike German, a\u00a0former FBI special agent and author of the <span>2019<\/span> book <em>Disrupt, Discredit, and Divide: How the New FBI Damages Democracy<\/em>, said the <span>2018<\/span> records appear \u200b<span>\u201c<\/span>to contradict the prosecution\u2019s argument that common tactics of anti-fascist protesters are evidence of criminal intent.\u201d He added that the FBI files, along with the underlying investigation, \u200b<span>\u201c<\/span>should have been disclosed so the defense could properly challenge the factual basis of [the] prosecution\u2019s\u00a0theory.\u201d<br\/><\/p>\n<\/div>\n<div>\n<p>The government\u2019s case relied in part on the perception that wearing black clothing to a\u00a0protest, communicating via encrypted texting app Signal and reading anarchist or anti-fascist literature was part of a\u00a0wider conspiracy to ambush and attack law enforcement. Or as the Trump administration would have it, to overthrow the\u00a0government.\u00a0<\/p>\n<p>German acknowledged that the FBI\u2019s assessment of Dallas Antifa could have changed since the <span>2018<\/span> investigation was closed. If that were the case, though, he suggested that a\u00a0more comprehensive account of law enforcement\u2019s opinion of antifa should have been aired in court\u2009\u2014\u2009particularly in a\u00a0trial that featured testimony from several FBI\u00a0agents.<br\/><\/p>\n<p>David Rudovsky, a\u00a0civil rights attorney and senior fellow at the University of Pennsylvania\u2019s Law School, who was not involved in the trial, said there is no question the records should have been included in\u00a0discovery.\u00a0<\/p>\n<p><span>\u201c<\/span>It goes to the core of what the government was saying,\u201d Rudovsky said, noting that while the agency\u2019s views could have changed since <span>2018<\/span>, the FBI files still offer a\u00a0rebuttal to the expert witness\u2019s theory of the case. \u200b<span>\u201c<\/span>To deprive the defense of that, I\u00a0think, is to deprive them of some pretty core Brady material,\u201d he added, referring to a\u00a0<span>1963<\/span> Supreme Court case which compels the prosecution to turn over any evidence that might be considered exculpatory or favorable to the\u00a0defense.\u00a0<br\/><\/p>\n<\/div>\n<div>\n<p>Trump\u2019s DOJ, particularly during his second term, has repeatedly flouted or ignored judicial orders, misrepresented evidence and taken actions deemed to be \u200b<span>\u201c<\/span>arbitrary and capricious,\u201d generally undermining public trust in the rule of law, in the assessment of non-partisan law and policy journal <em>Just Security<\/em>. According to an ongoing project spearheaded by the journal, there have been more than <span>120<\/span> rulings since <span>2025<\/span> in which courts have expressed distrust of government information and representations, including cases where prosecutors have not complied with discovery\u00a0orders.\u00a0<\/p>\n<p>The FOIA records obtained for this story are just a\u00a0small portion of the documents related to the <span>2018<\/span> Antifa DFW investigation. According to the government, in a\u00a0pending lawsuit brought by this author against the FBI, the agency possesses up to <span>250<\/span> pages of documents that have not been previously\u00a0released.<br\/><\/p>\n<\/div>\n<div>\n<\/div>\n<div>\n<p>When word of the verdict reached family and friends, members of the Prairieland support committee and activists gathered outside of the courtroom on the afternoon of Friday, March <span>13<\/span>, there was a\u00a0palpable sense of shock and disbelief. A\u00a0smaller group of committee members began drafting a\u00a0media response. Local television crews lined up outside of the main entrance. But guilty verdicts on nearly all charges was not one they had accounted for.
