Federal immigration agents have abducted Eustaquio Orozco Verdusco, a\u00a0workers\u2019 rights organizer well known in Minnesota for fighting wage theft and labor\u00a0trafficking.\u00a0<\/p>

His attorney and son say he is currently held at the Cibola County Correctional Center in New Mexico, run by CoreCivic, one of the largest private prison companies in the United States. For the first time, his family is going to the press as community support for his release is\u00a0swelling.<\/p>\n

\u201c<\/span>All we care about is having him back with us, at home in Minnesota,\u201d his son, Gerardo Orozco Guzman, told me. \u200b\u201c<\/span>That\u2019s all we\u00a0want.\u201d<\/p>\n<\/div>\n

Our interview followed a\u00a0judge\u2019s ruling in the District Court of Minnesota on Wednesday that denied and dismissed Orozco Verdusco\u2019s habeas corpus petition challenging his unlawful\u00a0detention.<\/p>\n

Orozco Verdusco organizes with Centro De Trabajadores Unidos En La Lucha (CTUL), a\u00a0worker center based in Minneapolis that has recently mobilized against federal immigration agents\u2019 abduction of construction workers from their job sites. He is also a\u00a0member of the Labor Council for Latin American Advancement (LCLAA), which advocates for the rights of Latino workers, and part of the Minnesota Immigrant Rights Action Committee, which opposes unjust immigration\u00a0policies.\u00a0<\/p>\n

His organizations and wider community, deeply rattled by his detention for about a\u00a0month, have been demanding his immediate release. Dozens of organizations and individuals have written letters of support, and a\u00a0petition \u200b\u201c<\/span>to demand his immediate release and stop his deportation\u201d has more than 3<\/span>,000<\/span>\u00a0signatures.\u00a0<\/p>\n

Orozco Verdusco was abducted in the Trump administration\u2019s so-called \u200b\u201c<\/span>Operation Metro Surge,\u201d where, since December, thousands of masked, armed federal agents have descended on Minnesota. They have raided homes and childcare centers, abducted young children, tear gassed high school students, and killed two residents and observers, Renee Good and Alex\u00a0Pretti.<\/p>\n<\/div>\n

While many of the people targeted are not in unions or worker organizations, several have been. Minnesota unions UNITE HERE Local 17<\/span> and SEIU Local 26<\/span> have both seen members abducted, including people who have led important worker organizing. And federal agents have targeted labor leaders across the country, from day laborer leader Willian Gim\u00e9nez Gonz\u00e1lez in Chicago to SEIU California President David Huerta in Los\u00a0Angeles.\u00a0<\/p>\n

Orozco Verdusco, who goes by \u200b\u201c<\/span>Paco,\u201d is originally from Mexico and has lived in the United States for 20<\/span>\u00a0years. He was taken the morning of January 9<\/span>\u00a0on the way to work, shortly after leaving his home in Coon Rapids, about a\u00a025<\/span>-minute drive north of Minneapolis. His son says he first found out when his uncle called and instructed him to go pick up his father\u2019s\u00a0car.\u00a0<\/p>\n

Getting the vehicle was unsettling, he says. \u200b\u201c<\/span>Everything looked in order. It was just eerie to have to get in the car, drive it back to my house, knowing that I\u00a0don\u2019t know when I\u2019m going to be seeing my dad\u00a0again.\u201d<\/p>\n<\/div>\n

Merle Payne, co-director of CTUL, said \u200b\u201c<\/span>he came into CTUL eight or nine years ago as a\u00a0construction worker who had seen a\u00a0lot of wage theft and a\u00a0lot of abuse of workers\u2019 rights and had just a\u00a0deep passion for justice and people being treated fairly in the\u00a0workplace.\u201d.\u00a0<\/p>\n

\u201c<\/span>He learned about his rights and was able to recover wages in his own situation,\u201d Payne said, \u200b\u201c<\/span>and then, as he learned about his rights, he wanted to teach others about it, and that\u2019s really what he dedicated his time\u00a0towards.\u201d\u00a0<\/p>\n

\u201c<\/span>As part of his collective work around wage theft over the years, people have been able to recover over $6<\/span> million in stolen wages, and he\u2019s been one of the core leaders in driving and making that happen,\u201d Payne says. \u200b\u201c<\/span>His work was crucial in bringing forward the first successfully prosecuted labor trafficking case in construction in the state. He played a\u00a0critical role in supporting workers to escape the trafficking and be able to come forward and bring that case to\u00a0justice.\u201d<\/p>\n

\u201c<\/span>The Trump administration is using the excuse of chasing fraud and who they refer to as criminals and that\u2019s not actually what\u2019s happening,\u201d says\u00a0Payne.<\/p>\n<\/div>\n

After he was taken, Orozco Verdusco was sent to Camp East Montana, in El Paso, where guards recently killed a\u00a0Cuban immigrant by choking him, as a\u00a0witness recounted. The detention center has been plagued by accusations of violent assault and poor conditions, including food shortages that leave people taking turns eating. While there, Orozco Verdusco\u2019s attorney, Marisa Tillman, says he was denied the right to a\u00a0video call with his lawyers at least three\u00a0times.\u00a0<\/p>

\u201c<\/span>It took me looking for as many emails as I\u00a0could of people at Camp East Montana, and emailing them outside of the system, to jostle it for them to actually schedule an appointment,\u201d said Tillman, a\u00a0consultant in the case for Prokosch\u00a0Law.<\/p>\n

Orozco Guzman, his son, works as a\u00a0legal assistant for the state of Minnesota, and has spoken with his father a\u00a0few times after the\u00a0abduction.<\/p>\n

\u201c<\/span>He\u2019s been saying that he\u2019s okay,\u201d Orozco Guzman says. \u200b\u201c<\/span>But with each call, his voice just sounds a\u00a0little sadder and\u00a0sadder.\u201d<\/p>\n<\/div>\n

Orozco Guzman describes their family as tight-knit and the abduction is affecting everyone. Orozco Guzman\u2019s mother has been staying with him and his wife at their home in a\u00a0Twin Cities suburb ever since the abduction, and for her, \u200b\u201c<\/span>each day is harder than the previous,\u201d her son\u00a0says.<\/p>\n

Orozco Guzman says his mother is trying to be optimistic, but seems distraught and distracted, and will sometimes repeat herself without realizing it. \u201c\u201cI can tell it\u2019s weighing on her. It\u2019s weighing on me. It\u2019s weighing on all of us. Those first couple days I\u00a0caught myself repeating things I\u00a0had already said, thinking I\u00a0hadn\u2019t said them, just because this has all jumbled up our\u00a0minds.\u201d<\/p>\n

Orozco Guzman said it\u2019s always been his father\u2019s dream to own a\u00a0home, and that came true last summer. \u200b\u201c<\/span>He finally bought his house in the suburbs. He\u2019s been a\u00a0lifelong carpenter, and he finally bought a\u00a0house.\u201d<\/p>\n

Grecia Palomar, president of the Twin Cities chapter of LCLAA, wrote a\u00a0letter of support for Orozco Verdusco, addressed to the immigration judge. \u200b\u201c<\/span>He has brought workers from the community to our meetings to speak directly about workplace conditions and to learn about the importance of unions, collective bargaining, and worker protections,\u201d she writes. \u200b\u201c<\/span>His ability to connect with workers, explain complex labor issues clearly, and inspire trust has had an admirable and meaningful impact on our outreach\u00a0efforts.\u201d<\/p>\n<\/div>\n

District of Minnesota Judge Paul A. Magnuson, in denying the habeas corpus petition, \u200b\u201c<\/span>has determined he agrees with what Trump\u2019s government has decided, that all immigrants who arrive in the United States without inspection fall under mandatory detention, meaning they\u2019re not even allowed a\u00a0bond hearing,\u201d Tillman\u00a0explains.\u00a0<\/p>\n

\u201c<\/span>In the decision, he even says that most of his fellow judges don\u2019t agree with him on that point, and the majority of Minnesota judges are approving these petitions, at the very least ordering a\u00a0bond hearing, and often ordering straight\u00a0release.\u201d<\/p>\n

Tillman says the judge\u2019s decision is \u200b\u201c<\/span>discouraging,\u201d because it means that Orozco Verdusco has to decide between fighting for his release back to his home from detention by, for example, trying for another habeas corpus petition in New Mexico, where he is currently detained, or leaving the country, which means he would no longer be locked up, but would potentially be unable to return to his family in the United States for 10<\/span>\u00a0years.<\/p>\n

\u201c<\/span>So we\u2019re working with him now to kind of see what he prefers to do,\u201d says Tillman, who has a\u00a0personal connection to his case: She is the sister of Orozco Guzman\u2019s wife. \u200b\u201c<\/span>I\u2019m not incarcerated, so I\u00a0can\u2019t make the decision. None of us can make that decision for him, because we can\u2019t imagine what it\u2019s like in\u00a0there.\u201d<\/p>\n

Orozco Guzman says of his father, \u200b\u201c<\/span>He\u2019s always believed in the American dream, much more than I\u00a0have.\u201d<\/p>\n
